1. Acceptance of Terms

By accessing or using the Kaurt website, application, or any services provided by Kaurt ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Kaurt is a peer-to-peer social wagering platform that enables users to create, accept, and settle challenges on real-world events. Kaurt acts solely as a technology platform facilitating interactions between users. Kaurt is not a sportsbook, gambling operator, or financial institution. We do not take positions on any wagers, set odds, or act as a counterparty to any challenge.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service, you represent and warrant that you meet all eligibility requirements. You are solely responsible for ensuring that your use of the Service complies with all applicable local, state, national, and international laws and regulations.

4. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password you use to access the Service and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. User Conduct

You agree not to use the Service to:

• Violate any applicable law, regulation, or ordinance
• Engage in fraud, deception, or manipulation of challenge outcomes
• Create challenges involving illegal activities
• Harass, abuse, or harm another person
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use any automated means to access the Service for any purpose without our express written permission

6. Challenges & Wagers

All challenges created and accepted on the platform are agreements between individual users. Kaurt does not guarantee the outcome, enforcement, or settlement of any challenge. Users are solely responsible for the terms they set and agree to. Kaurt reserves the right to remove any challenge that violates these Terms or is otherwise deemed inappropriate at our sole discretion.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Kaurt and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Kaurt.

8. Limitation of Liability

In no event shall Kaurt, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service. Kaurt's total liability to you for all claims arising out of or relating to the use of the Service shall not exceed the amount you paid to Kaurt in the twelve (12) months preceding the claim.

9. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance. Kaurt does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
